1. Overview & Acceptance
This website is operated by BKRSCLB (“BKRSCLB,” “we,” “us,” or “our”). Throughout the site, the terms “service” and “products” refer to all physical apparel, accessories, physical audio formats (vinyl, cassettes, CDs), hardware accessories, collectibles, and digital products (audio downloads, master files, digital media) offered through BKRSCLB.COM.
By accessing our site, browsing, or purchasing from our store, you engage in our Service and agree to be bound by the following Terms of Service. If you do not agree to all terms and conditions, you may not access the website or use any services.
2. Product Offerings & Availability

  • Limited Drops & Pre-Orders: Many items offered on BKRSCLB are limited-run editions, exclusive pressings, or made-to-order releases. We reserve the right to limit sales quantities per person, household, or order.
  • Descriptions & Display: We make every effort to display garment colors, vinyl mockups, and product specs accurately. Variations in vinyl pressing patterns, dye processes, or screen calibrations may occur.
  • Pricing & Modifications: Prices for all products are subject to change without notice. We reserve the right to modify or discontinue any item or digital release at any time.

3. Digital Goods & Intellectual Property

  • License for Digital Media: When purchasing digital audio files, beat tapes, digital albums, or digital artwork, BKRSCLB grants you a personal, non-exclusive, non-transferable, revocable license for personal, non-commercial listening and archival use.
  • Restrictions: You may not copy, redistribute, resell, broadcast, sublicense, or publicly perform purchased digital audio files or use them for commercial sample-clearance purposes unless a separate written agreement is executed with BKRSCLB or the respective copyright holders.
  • Ownership: All logos, artwork, audio recordings, video assets, apparel designs, and website content remain the exclusive intellectual property of BKRSCLB and its affiliated artists.

4. Orders, Shipping & Fulfillment

  • Accuracy of Billing Information: You agree to provide current, complete, and accurate purchase and account information for all transactions.
  • Fulfillment Timelines: In-stock apparel and merchandise typically process within standard warehouse timelines. Pre-order items (such as vinyl pressings, custom embroidery runs, or imported goods) follow estimated production timelines provided on the product page. BKRSCLB is not responsible for vinyl plant delays or carrier supply-chain disruptions.
  • International Orders & Customs: For orders outside of Canada, the customer is solely responsible for all applicable import duties, customs fees, taxes, and handling charges imposed by local border authorities.
  • Lost or Stolen Packages: Once tracking confirms transfer to the carrier (Canada Post, USPS, DHL, etc.), risk of loss transfers to the buyer. BKRSCLB is not liable for packages lost, stolen, or delivered to incorrectly provided addresses.

5. Refund, Return & Cancellation Policy

  • Physical Merchandise: Due to the limited nature of our drops, all sales of physical apparel, headwear, vinyl, cassettes, CDs, and collectibles are final.
  • Damaged / Defective Items: If an item arrives physically damaged or has a verifiable manufacturer defect (e.g., warped or unplayable vinyl), you must contact support within 7 days of delivery with photographic/video proof and order details to be eligible for a replacement or store credit.
  • Digital Products: All digital sales (MP3, WAV, digital bundles) are strictly non-refundable once download links are delivered.

6. Third-Party Links & Integrations
Our store may link out to external platforms, affiliated artist stores, or third-party streaming/distribution tools. BKRSCLB is not responsible for examining or evaluating the content, privacy practices, or terms of third-party websites.
7. Prohibited Uses
You are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts.
  • To infringe upon or violate the intellectual property rights of BKRSCLB or any affiliated creators.
  • To upload viruses, scrape store inventory data via automated bots, or disrupt storefront security features.
  • To purchase merchandise using unauthorized payment methods or for unauthorized resale/scalping.

8. Disclaimer of Warranties & Limitation of Liability
We do not guarantee that your use of our service will be uninterrupted, completely error-free, or timely. To the maximum extent permitted by law, BKRSCLB and its founders, directors, employees, and affiliates will not be liable for any injury, loss, claim, or direct/indirect damages arising from your purchase or use of any product or service obtained via BKRSCLB.COM.
9. Governing Law
These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
